For the purposes of this Policy, the term "User", "visitor", "customer" or "you" is defined as the natural or legal person visiting the website. The term "we", "us", "our" refers to the www.jacob.si website.

3. Legal basis and purpose of processing
JACOB d.o.o. collects, records, processes, stores, transmits and otherwise processes the personal data we hold about you on the basis of various legal grounds and for the purposes set out below.
3.1. Processing on the basis of a contract
JACOB d.o.o. processes personal data for the exercise of rights and obligations in the context of the exercise of rights and performance of contractual obligations. JACOB d.o.o. processes personal data of individuals for the purposes of identification of the individual.
3.2. Processing under the law
JACOB d.o.o. processes personal data on the basis of legal obligations applicable to JACOB d.o.o. (e.g. in particular tax regulations, storage of invoices, storage of prize winners' data, etc.).
3.3. Processing based on legitimate interests
JACOB d.o.o. may process personal data on the basis of legitimate interests pursued by JACOB d.o.o., except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require the protection of personal data. Where further processing of data collected about a data subject is involved, JACOB Ltd. shall carry out an assessment in accordance with the General Data Protection Regulation. For example, such further use of data in pseudonymised or aggregated (aggregated) form constitutes a legitimate use of the data for marketing and other business or technical analyses of JACOB d.o.o.. As an additional measure for some forms of further processing of traffic data, the deletion of certain data may also be applied. On the basis of legitimate interests, JACOB d.o.o. may also process your personal data for the purposes of direct marketing (in the case of customers), preventing abuse, asserting or defending claims in administrative and judicial proceedings.
3.4. Processing on the basis of consent (consent)
JACOB d.o.o. processes personal data on the basis of the consent to the processing of personal data given by the data subject to the company for the following purposes:
I.) for direct marketing purposes - to receive notifications. The notifications contain current offers, benefits and/or invitations to events of the Manager and its business partners, invitations to participate in prize draws and competitions, and useful tips, news and reminders from the world of lifestyle, style, etc.;
II.) to carry out marketing analyses and segment customers and to provide tailored offers of products and services;
III.) for the purpose of participating in prize draws;
IV.) for other purposes in the course of the Company's business.
Depending on the personal data you provide, you may receive notifications and personalised offers by email, SMS, MMS to the mobile phone number you provide, or in hard copy to the address you provide.
You may withdraw or modify your consent at any time in the same way as consent was given; by clicking on the unsubscribe button at the bottom of the email; in your account settings; or by sending a request to withdraw consent for a specific purpose to info(ad)jacob.si
Where consent involves direct marketing based on an individual's profile, JACOB d.o.o. may carry out segmentation of individuals based on their use of JACOB d.o.o.'s websites for the purposes of tailored offers of services and products.
4. What personal data we collect
JACOB d.o.o. collects a variety of information about you, including personal data that can be used to directly or indirectly identify (identify) you, if you or others choose to share this personal data with JACOB d.o.o. We receive this information in a number of ways, including by subscribing to e-newsletters (direct marketing), registering for an account on the https://www.mjacob.si online shop or visiting JACOB d.o.o.'s websites. Personal data we collect:
I.) basic personal data such as first and last name, date of birth, email address, residential address (street address, street number, postcode, city, country), delivery address (street address, street number, postcode, city, country), telephone number and password to ensure the security and use of our services;
II.) the purchase data and the method of payment, whereby in the case of payment in the online shop using a credit card, the content of the card data shall not be stored in the databases of JACOB d.o.o.;
III.) JACOB d.o.o. allows you to register using user accounts that you create with third parties such as Facebook or Google. By registering in this way, you provide us with information about your e-mail address or your Facebook account (if you register via a Facebook account, we only collect the information provided in your public profile, such as your name, e-mail address, your account ID number and your account profile picture), whereby we can import your contacts with consent to access third-party services (e.g. The controller of this data and information is the third parties who provide it to us on the basis of their privacy policy. In principle, you can manage the data and information we obtain from third parties (e.g. social networks) yourself using the privacy settings in your account settings with the third parties.
IV.) the information we collect may also include (1) location data using GPS (but we do not store location data), where you may choose to turn off the collection of geolocation data, which may disable certain functionality of the website or online shop that uses this data (e.g., sharing location data); (2) information about your device through which you access the website or online shop (device type, operating system, (3) IP address, and (4) information about the use of the website or online shop;
V.) we collect technical information from your browser, computer or mobile device when you access the JACOB d.o.o. services.
5. Transmission of personal data
5.1. Contract processors
JACOB d.o.o. may transfer your personal data to third parties with whom we have concluded contracts for the processing of personal data ("Contract Processors") for the purposes of supporting, analysing and continuously improving our services, processing payments or delivering orders. Contract processors are only entitled to the personal data that they strictly need to provide the services they provide to us and only for the purposes of carrying out these tasks on our behalf and may not use it for any other purpose. Contract processors are obliged to protect your personal data and JACOB d.o.o. concludes specific contracts with them for the processing of personal data. Currently, JACOB d.o.o. does not use external contract processors. JACOB d.o.o. may work with contract processors who process statistical data about your use of our services for us, in order to advertise our services or to display information that may be of interest to you. Such processors will only hold anonymised data.
5.2. Publicly available information
Some information about you may be publicly available, such as information you provide or share online (e.g. events, pictures, comments, ....) or posting a comment on a website or social networking site, etc.
5.3. Third party websites and applications
We may share your personal data with third party applications with your consent if you choose to access our services through such an application (e.g. Facebook, Google account). JACOB d.o.o. is not responsible for what third parties do with your data, so you should make sure that you trust the application and that it has adopted appropriate data protection guidelines. There are links on the JACOB d.o.o. websites to websites that are not under the control of JACOB d.o.o.. By visiting these sites, you may provide your information to third parties with whom JACOB d.o.o. does not have a contract for the processing of personal data. 5.4. Joint Managers
We may share your personal data with contractual partners with whom we act as a joint controller who process your personal data in accordance with this Privacy Policy (e.g. the case of a prize draw in cooperation with suppliers). In each case, we will inform you of such cases in the general rules of the prize draw.
5.5. Universal legal succession
In the event of a merger, or JACOB d.o.o. is involved in a business combination, division or there is a transfer of activities to a third party, we may transfer your data to the third party associated with the acquisition of JACOB d.o.o.
5.6. Public authorities
Notwithstanding the provisions regarding the retention period of personal data under the Privacy Policy, we may retain your personal data for a longer period of time and may disclose it to third parties such as the police, prosecutor's office, court and other competent state authorities within or outside the Republic of Slovenia, if we deem such disclosure necessary and required by law, including for the purposes of preventing, investigating, detecting or prosecuting criminal offences. We may also disclose your personal data to state authorities where this is necessary for the establishment, exercise or defence of legal claims in legal proceedings or in administrative or extrajudicial proceedings.
Transmission of data to non-EU or non-EEA countries
If you use online services outside of EU Member States, the data you provide may be transferred, stored or processed in third countries where data protection legislation requires different standards than in EU or EEA Member States in order to provide online services. By using services in countries outside of the EU, you agree that your personal data may be transferred or transmitted to entities located in third countries.
JACOB d.o.o. will not itself export your personal data to countries that have a geolocation outside the EU or EEA.
6. Time limits for the retention of personal data
We keep personal data for as long as is necessary to provide our services or longer if there are legal obligations.
The personal data associated with your user account will be stored until the account is closed, in which case the data related to the purchase made by the user in the online shop will be retained. You can close your user account yourself in your account settings or ask us to delete it. It may take up to 15 working days from the time of the complete request to close the user account and delete your personal data. Please note that we may retain certain information from closed accounts as permitted by law to prevent fraud, collect debts, resolve disputes, troubleshoot problems, assist in investigations by competent authorities, enforce the Terms of Service, and take other actions as permitted by law. The information we retain will be treated in accordance with this Privacy Policy.
For the purpose of fulfilling contractual obligations, data relating to the payment of purchases in the online shop and the related contact details of individuals may be stored until full payment for the services has been made or until the expiry of any limitation period relating to the individual claim, which may be up to 5 years under the law. In accordance with the tax rules, invoices issued shall be kept for 10 years after the end of the year in which the invoice is issued.
Personal data obtained on the basis of consent is retained until the consent is withdrawn, but for a maximum period of 5 years.
We may anonymise data about you that is no longer necessary for the purposes for which it was collected or otherwise processed and combine it with other non-personally identifiable data to gain insight into statistical information that is commercially useful to JACOB d.o.o., such as statistics on the use of the services we provide. This personal data is anonymised and does not offer a link to an identifiable individual.
7. Protection of personal data
JACOB d.o.o. implements a number of technical and organisational measures to ensure the security of personal data during collection, transmission and storage. JACOB d.o.o. endeavours to adequately protect your personal data, but we do not guarantee the complete security of the personal data you provide to us and we are not liable for the theft, destruction, loss, intentional or accidental disclosure of your personal data or information about you. JACOB d.o.o. complies with generally accepted standards for the protection of information received, both during transmission and after receipt, but no method of electronic transmission or storage is 100% secure and we cannot guarantee complete security. JACOB d.o.o. uses SSL (Secure Sockets Layer) technology to provide encryption of personal and credit card information. JACOB d.o.o. guarantees the security of our services and your personal data. JACOB d.o.o.'s servers are additionally protected by the use of firewalls and other technologies to ensure data security.
It is also the user's responsibility to protect their data by ensuring that their mobile device or computer is properly secured, as well as by protecting their username, password and the appropriate software (anti-virus) protection of their electronic device. To ensure that these measures are effective in preventing unauthorised access to your personal data, you should be aware of the security features available to you through your browser. JACOB d.o.o. is committed to protecting your personal data and information, but no connection over the Internet can be 100% secure and we cannot guarantee the complete security of the information you provide to us. 8. Rights of individuals
JACOB d.o.o. ensures the exercise of the rights of data subjects. Requests by an individual concerning the exercise of rights may be sent to the e-mail address info(ad)jacob.si or by post to JACOB d.o.o., Ihanska cesta 3, SI-1230 Domžale. The individual is obliged to provide proof of identity and/or address for requests not sent from the registered user's e-mail address. JACOB d.o.o. will respond to your request in accordance with the applicable regulations.
The data subject has the following rights in relation to personal data:
8.1. Right of access to data
The data subject may, at any time, request that JACOB d.o.o. confirms whether data relating to him or her are being processed and, if so, provides access to personal data and information concerning the processing of his or her personal data (e.g. the purpose of the processing, the type of personal data, the users to whom the personal data have been or will be disclosed, the envisaged period of retention of the personal data, the technical and organisational measures for the protection of the personal data, etc.).
8.2. Right to rectification
The data subject may at any time request that JACOB d.o.o. allow the correction of inaccurate personal data concerning him or her and the completion of incomplete personal data.
8.3. Right to erasure
In accordance with the terms and conditions set out in more detail in the applicable regulations, the data subject may at any time request that JACOB d.o.o. grant him or her the right to erasure of personal data (the so-called right to be forgotten).
8.4. Right to restriction of processing
In accordance with the terms and conditions as further specified by the applicable regulations, the data subject may at any time request that JACOB d.o.o. grants him or her the right to restrict the processing of his or her personal data. Registered users of the online services can do so in your account settings. Please note that if we restrict the processing of certain personal data, we may not be able to provide you with a complete service.
8.5. Right to data portability
The data subject may, at any time, request that JACOB d.o.o. allow the personal data to be provided to the data subject or transferred to a controller of the data subject's choice (if technically feasible), in a structured, commonly used and machine-readable format, under the terms and conditions set out in more detail in the applicable regulations.
8.6. Right to object

JACOB d.o.o. will cease processing such personal data unless it deems that it has compelling legitimate grounds for continuing to process them or if processing is necessary for legitimate reasons. 8.7 Withdrawal of consent
The individual may withdraw consent at any time, in cases where he or she has given consent for a specific purpose for the processing of your personal data. Registered users can withdraw consent at info(ad)jacob.si. Withdrawal of consent does not affect the lawfulness of the processing of personal data that was carried out until its withdrawal.
8.8. Right of appeal to the supervisory authority
The individual has the right to lodge a complaint with the Information Commissioner of the Republic of Slovenia if he or she considers that his or her personal data are being processed in breach of the applicable regulations governing the protection of personal data. The procedure for lodging a complaint with the supervisory authority is published on the website of the supervisory authority.
